About
The Common Scold

The Common Scold is named after a cause of action that originated in Pilgrim days, when meddlesome, argumentative, opinionated women who displeased the Puritan elders were punished by a brisk dunk in the local pond. Believe it or not, the tort lasted until 1972, when State v. Palendrano, 120 N.J. Super. 336, 293 A.2d 747 (N.J.Super.L., Jul 13, 1972) pretty much put it to rest. But the thought of those feisty women, not afraid of a little cold water, has always cheered me up and inspired me. I first used the moniker as the name of my humor column at the University of San Francisco School of Law many moons ago, and revive it now for this blawg!

Awards & Accolades!

21639877 In the December issue of Law Technology News, we announced the winners of the 2010 LTN Vendor Awards.

The awards have evolved from the early days of LTN, when they were calculated by how many folks requested information via the "bingo" postcards included in each issue. Today, it's much more sophisticated. Results are determined by analyzing the responses to our LTN Vendor Satisfaction Survey, conducted online, explains Kevin Iredell, head of ALM's legal intelligence division.

Congrats to all the winners! And a reminder to submit nominations for the LTN law firm and law department awards by Dec. 13. Application form is here.

Tick Tock!

20092240 Accolades from your peers not only help your own career, but reflect well on your law firm or law department. So here's an opportunity to spotlight your achievements: Submit a nomination for our eighth annual juried LTN Awards. Winners will be honored at LegalTech New York 2011.

We have five awards including IT Director of the Year, IT Champion of the Year (someone other than IT staff), and three awards for the most innovative use of technology: in a law firm, in a law department, and in a trial.

The nomination process is painless. Just download, complete, and submit the simple Nomination Form. The instructions are on the form. There is no fee, and you may nominate folks from outside of your organization. Deadline: Wednesday, December 1, 2010. (Technology projects must have been completed between Aug. 1, 2009, and July 31, 2010.)

The nominations will be judged by Andrew Adkins III, director of the Law Technology Institute; Fredric Lederer, chancellor professor of law and director of the Center for Legal and Court Technology at the William & Mary Law School; and David Whelan, manager, legal information, Great Library at the Law Society of Upper Canada.

As they say in the lottery, you can't win if you don't submit a nomination! Questions? Send a message to lawtech@alm.com or call Heather Schultz at (212) 457-9601.

& THE WINNER IS.....

LTNlogo3 As they say in all that propaganda for the New York Lottery: “You can’t win if you don’t enter.”  Nominations are now open for the Law Technology News 2009 Awards. Here’s how it works: there are three  food groups: 1) Vendor Awards, 2) Law Firm & Legal  Department Awards, and 3) a brand new category, Lifetime Achievement Award. Law Technology News subscribers vote for the Vendor Awards; an independent jury of three members of LTN’s editorial advisory board select the LF/LD awards, and I will pick the recipient of the Lifetime Achievement accolade, who will be chosen from our wonderful legal technology community.
To win a vendor or LF/LD award, the organization or person must be nominated. It’s a very, very, easy process — just download the form  and return it to us — by 7/31/09 for vendor categories, and by 11/6/09 for LF/LD nominations.
You can also use the LF/LD form to nominate a candidate for the Lifetime Achievement award (limited to age 55+), but in that category, unlike the lottery, you can win even if you are not nominated. (But I welcome all suggestions!)
Got questions? Contact Kevin Iredell  or visit our website.
