The Common Scold

The Common Scold is named after a cause of action that originated in Pilgrim days, when meddlesome, argumentative, opinionated women who displeased the Puritan elders were punished by a brisk dunk in the local pond. Believe it or not, the tort lasted until 1972, when State v. Palendrano, 120 N.J. Super. 336, 293 A.2d 747 (N.J.Super.L., Jul 13, 1972) pretty much put it to rest. But the thought of those feisty women, not afraid of a little cold water, has always cheered me up and inspired me. I first used the moniker as the name of my humor column at the University of San Francisco School of Law many moons ago, and revive it now for this blawg!

Starstripe_3Our ALM family lost one of our favorites, when Jim Giordano lost his valiant fight against cancer Saturday.

Jim Describing Jim requires a whole box of adjectives: kind, funny, smart, sweet, dedicated, talented, patient, big-hearted, generous, optimistic, cheerful, enthusiastic, tolerant, insightful, considerate, thoughtful .... etc. etc. etc. He was our midwest display advertising rep, and he and I often visited vendors together, to learn about their products and services. He was the best possible companion for these journeys.

Jim humored my passion for the NY Yankees -- and the two of us conspired together to do our first ALM "group game" in 2004 -- to see the Yankees play the Twins at the Dome in Minneapolis. That game  started a  tradition that has continued ever since. It's a chance for us to get together with the MSP legal tech community, including vendors, edit board members, CIOs, etc., and everybody has a blast. Jim particularly enjoyed the fact that the Twins managed to slaughter the Yankees, every single year, at our group game.

On April 10th, when I head back to the Dome for the 4th annual TwinsFest, I'm going to toast Jim. And if when the Twins win, as I'm sure they will, I'll just look up to the stars and smile, because they will be sparkling even brighter with Jim's laughter.
