About
The Common Scold

The Common Scold is named after a cause of action that originated in Pilgrim days, when meddlesome, argumentative, opinionated women who displeased the Puritan elders were punished by a brisk dunk in the local pond. Believe it or not, the tort lasted until 1972, when State v. Palendrano, 120 N.J. Super. 336, 293 A.2d 747 (N.J.Super.L., Jul 13, 1972) pretty much put it to rest. But the thought of those feisty women, not afraid of a little cold water, has always cheered me up and inspired me. I first used the moniker as the name of my humor column at the University of San Francisco School of Law many moons ago, and revive it now for this blawg!

KICK OFF

Laltcowen06_012_1 The Cowen Group held a delightful kick off dinner at Los Angeles' The Palm last night, drawing a terrific group -- mostly litigation support executives -- including Law Technology News board members Betsy Reynolds (right)(Manatt), Tom Baldwin (Sheppard Mullin), and new board member Linda Alele (O'Melveny) (right below, with Law.com's David Snow).

Laltcowen06_005 Over steaks and lobsters, and amazing key lime pie, a lively dinner discussion covered the range of predictable and unpredictable topics (from billing for non-lawyer time Laltcowen06_004 to listing execs on firm websites to instant messaging protocols). Lots of topic ideas for future articles in LTN and Law Firm Inc.

Laltcowen06_003Kudos to host David Cowen for bringing together such interesting and spirited folks, who also included Bil Kellerman (CT Summation); and consultant Dennis Kennedy (above left); John Tisch (Gibson Dunn); Thad Hymel (McGlinchey) (who will join me today on our Disaster Recovery panel); Joy Murao (Latham) (left, with Greg Chan (Kirkland & Ellis); and about a dozen other attendees.

Cowen's lit support headhunting firm has offices in New York and Washington, D.C. Cowen also has a blog, here.
