The Common Scold



The Common Scold is named after a cause of action that originated in Pilgrim days, when meddlesome, argumentative, opinionated women who displeased the Puritan elders were punished by a brisk dunk in the local pond. Believe it or not, the tort lasted until 1972, when State v. Palendrano, 120 N.J. Super. 336, 293 A.2d 747 (N.J.Super.L., Jul 13, 1972) pretty much put it to rest. But the thought of those feisty women, not afraid of a little cold water, has always cheered me up and inspired me. I first used the moniker as the name of my humor column at the University of San Francisco School of Law many moons ago, and revive it now for this blawg!

DIVERSITY AMONG BLOGGERS

C2cCoast to Coast, a nifty podcast by Bob Ambrogi and J. Craig Williams, covers the topic of diversity among bloggers in its current edition. The hosts invited the fabulous Lisa Stone, lawyer/humorist Sean Carter, et moi to serve as guests.

It was a fascinating process to tape the show, and to be honest, I was surprised at how flat-out substantive the program was. I really didn't expect a podcast to be able to contain a nuanced debate, but it does indeed.

You might be surprised that Lisa (doyenne of law.com's Legal Blog Watch column) and I both agreed that there are plenty o' women out there in the blawgosphere -- But you probably won't be surprised that we both feel an important issue is that mainstream media tend to ignore us and focus on the white males when citing our commentaries. (Lisa points to the coverage of Harriet Mier's nomination to the Supremes.)

Sean offers some fascinating observations as an African American blawger, that resonated with all of us. He ponders why women and minorities bloggers often are told outright not to identify their blogs with their firms/companies, hence missing many opptys to promote their employers.
