The Common Scold



The Common Scold is named after a cause of action that originated in Pilgrim days, when meddlesome, argumentative, opinionated women who displeased the Puritan elders were punished by a brisk dunk in the local pond. Believe it or not, the tort lasted until 1972, when State v. Palendrano, 120 N.J. Super. 336, 293 A.2d 747 (N.J.Super.L., Jul 13, 1972) pretty much put it to rest. But the thought of those feisty women, not afraid of a little cold water, has always cheered me up and inspired me. I first used the moniker as the name of my humor column at the University of San Francisco School of Law many moons ago, and revive it now for this blawg!

KATRINA UPDATE

Hurricane Ross Kodner has been marshalling the legal tech troops to help respond to our Gulf colleagues who have been affected by Hurricane Katrina. He and his colleagues have now launched www.helpkatrinalawyers.org.

Says Kodner:

"The point is to marshall resources tapping our legal technology, law practice management and disaster/data recovery skills so Katrina-affected lawyers can find this information on one consolidated site. Please enter your full volunteer information and be sure to describe it in detail non-geeks can understand.

Please be clear if the service or the donated products are gratis or involve a reduced fee. This is not a place to list yourself or your products if you are not offering some kind of no-charge or significantly discounted offering -- this is not intended to be advertising - it is a resource to help those in need -- presumably as others would undoubtedly offer to us if we were in need."

He's also seeking volunteers to help with a CLE course via West LegalEdCenter:

"For anyone interested in taking part in WestLegalEdCenter teleconference CLE-like presentations on disaster recovery, restarting disrupted practices, etc. please e-mail me with the phrase CLEHELP in the subject - next step will be quickly creating the content for Steve Daitch and his team at West to broadcast for us."
