The Common Scold



The Common Scold is named after a cause of action that originated in Pilgrim days, when meddlesome, argumentative, opinionated women who displeased the Puritan elders were punished by a brisk dunk in the local pond. Believe it or not, the tort lasted until 1972, when State v. Palendrano, 120 N.J. Super. 336, 293 A.2d 747 (N.J.Super.L., Jul 13, 1972) pretty much put it to rest. But the thought of those feisty women, not afraid of a little cold water, has always cheered me up and inspired me. I first used the moniker as the name of my humor column at the University of San Francisco School of Law many moons ago, and revive it now for this blawg!

PENALTY BOX

Penalty_4 O.K., I've been threatening to do this for a long, long time, but today's the day. I've created a Solutions Penalty Box over on the right nav bar where I am going to keep track of the top contenders for the most flagrant abuse of the word "solution" in press releases.

I got two press releases today with THIRTEEN "solutions" scattered thru-out the content. And I know they aren't the worst offenders. (I didn't save the press release, but I think the current trophy holder for all-time champion was a release with six "solutions" in the first paragraph.)

So in my ever-indignant and vigilante way, you're now on notice!!! Beware the PENALTY BOX!!! (Mean, mean, Mon.) The number in front of the list is how many "solutions" are in the release. Scroll the nav bar down a bit to find the box you don't want to be in!

Monica,
I just had a conversation yesterday that went something like this: "But what is a solution? Is it software? Is it a tangible thing?" I had the flak on the line sputtering. So -- thanks once again for being my editing soul mate.
