The Common Scold



The Common Scold is named after a cause of action that originated in Pilgrim days, when meddlesome, argumentative, opinionated women who displeased the Puritan elders were punished by a brisk dunk in the local pond. Believe it or not, the tort lasted until 1972, when State v. Palendrano, 120 N.J. Super. 336, 293 A.2d 747 (N.J.Super.L., Jul 13, 1972) pretty much put it to rest. But the thought of those feisty women, not afraid of a little cold water, has always cheered me up and inspired me. I first used the moniker as the name of my humor column at the University of San Francisco School of Law many moons ago, and revive it now for this blawg!

SAD NEWS

Jimkeane We've just received word, through Craig Ball, that James Keane (left) lost his battle with lung cancer today. Keane was a vibrant leader in the legal technology world, and I have fond memories of his enthusiasm and dedication.

I did not know Jim well, but always liked him and admired his dedication. My last warm memory of Jim was at LegalTech NY -- where I almost didn't recognize him because he was now stylishly bald. He teased me about that, with his usual good spirit and humor, and we had a funny e-mail exchange. He faced his medical challenge with candor and courage. We'll miss him.

We send our keen condolences to family, and hope they are buoyed by the knowledge of how much Jim was appreciated in our community.

Both the Washington Post's online listings, and the funeral home, have online guest books that we can all sign to express our condolences and remembrances for the family. I'll find the links and add them here. I think Jim would have gotten a big kick out of that!
