The Common Scold



The Common Scold is named after a cause of action that originated in Pilgrim days, when meddlesome, argumentative, opinionated women who displeased the Puritan elders were punished by a brisk dunk in the local pond. Believe it or not, the tort lasted until 1972, when State v. Palendrano, 120 N.J. Super. 336, 293 A.2d 747 (N.J.Super.L., Jul 13, 1972) pretty much put it to rest. But the thought of those feisty women, not afraid of a little cold water, has always cheered me up and inspired me. I first used the moniker as the name of my humor column at the University of San Francisco School of Law many moons ago, and revive it now for this blawg!

XM RADIO ROCKS

Xm_1 I finally did it.... Nope, I didn't buy an iPod (I'm tempted but I keep hearing about lousy battery life)... I bought a Delphi MyFi XM satellite radio. It's way, way, way, kewl.

XM had a big promotion (complete with a huge truck-that-becomes-a-display station) last Saturday at Myfi_1 Dave's TV -- our wonderful Millerton, N.Y. electronics shop. It was held in conjunction with our Lakeville-based radio station 103.3 WQQQ. I was driving toward Salisbury, heard the radio promo, and literally turned the car around and headed for Dave's. Talk about any easy sell, I've been chomping at the bit to get one of these.

Yeah, yeah, I mostly was motivated by my um, er, well "addiction" to Yankees games. I knew I was gonna pull out the checkbook after my last layover at O'Hare, where I was stuck for two hours, in a dead spot with no wireless access -- so I couldn't watch MLB-TV on my computer, and could only get scores on my Treo.

What's great about XM Satellite Radio is you can get every single MLB game - play by play - live. Every single game. And there's news, and traffic, and weather, and music, and it's just great. Check out this link to see programming options.

It's not perfect, but great. In the car it gets a bit spotty in some terrain -- but I'll put up with a little static. The handheld unit fits into a car cradle, and runs thru your FM radio. Outside the car, it runs standalone on batteries. (There's even a "wearable antenna" - I'm not kidding - but so far I haven't needed it.)

The Delphi radio runs roughly $300 (the price of Bose headsets) -- and I only had to pay a modest $25 bucks to get the car installation set up. The monthly subscription is $12.95, but you can push down the cost by prepaying for a longer plan. (I went for 2 years.)

Promo_img_roady2top The only caveat: I was not impressed with the "double play" free second radio promo -- It's not exactly free -- the fine print requires you to switch to the family plan for an additional $6.99-ish a month (per extra radio). (If you don't sign up, they hit your credit card with $100 fee.)

However, if you have a significant other or kids, it might be a very good deal. (I just the promo was just a tad bit misleading -- I thot I'd get two radios for my one account, so I could leave one in the car. But no biggie.)

I actually read that article last night. Sounds like XM is the smart bet. I'm no Warren Buffet, but how do you trust a managment team like the one at Sirius which commits to $500 million in personality contracts coming off a year where they only did $67 million in revenue and LOST $712 million????
I was on the fence until I read that article. Its a no-brainer. XM is the way to go

XM v. Sirius

First, my guess is that Sirius and XM will merge at some point, so debating them probably does not really matter long term. But as far as the hiring of Howard Stern (Monica - watch your traffic go up by having his name on your Web page), I think it was an extremely smart business move, especially given Sirius' market position at the time. And here is why I believe what I believe...

Sirius had fallen far behind XM, and by hiring Howard they were able to quickly gain mind share, AND get Mel Karmazin, a hands on manager (who has proven he can take a small company and turn it into a large company) to run things. $500 million is cheap relative to the publicity they were able to get (and are still getting) by hiring Howard. Without the move, I do not think Sirius could have stayed in the game. Sirius will easily recoup this with increased subscribers thanks to that PR (Stern listeners will subscribe and Mel brings long term business credibility). Sirius still has a way to go to catch up with XM, but they seemed to have turned a corner.

And getting Mel, well he will bring in an entirely old model to the new medium… advertising, which will eventually prove to be a large proportion of the total revenues of Sirius. He knows who to hire and how to make the advertising market go.

Regardless of what you think about Howard's on air personality, the guy does do one thing well... he make his employers money. I think it was a good deal for both. As far as which has better programming… MLB (and World Cup) v. NFL… it is really a matter of personal sports preference.
