The Common Scold



The Common Scold is named after a cause of action that originated in Pilgrim days, when meddlesome, argumentative, opinionated women who displeased the Puritan elders were punished by a brisk dunk in the local pond. Believe it or not, the tort lasted until 1972, when State v. Palendrano, 120 N.J. Super. 336, 293 A.2d 747 (N.J.Super.L., Jul 13, 1972) pretty much put it to rest. But the thought of those feisty women, not afraid of a little cold water, has always cheered me up and inspired me. I first used the moniker as the name of my humor column at the University of San Francisco School of Law many moons ago, and revive it now for this blawg!

TALK ABOUT TALKING HEADS

Blogbot Our pal Andy Havens, over at the Legal Marketing blog, puts a new definition on "talking head." When you log onto Andy's blawg, his broadcast-quality voice can be heard emanating from an animated head... (Think Conan O'Brien). He does a quick little animation-cast (about 60 seconds). It's quite entertaining.

HavensI think the proper geek word is "avatar." Andy tells me the service is provided by oddcast.com.

And check this out -- Andy's eyes will follow your mouse! Really! Check it out. For comparison, here is his mug in a traditional medium (to the right).

Truly clever!

Update 3/14: Andy decided to euthanize the avatar (actually he insists it has simply been exiled to an offshore server in the Bahamas where it is reading poetry. Why? Too many complaints that it was irritating. (It was cute, but got quickly annoying because you couldn't turn it off.)
