The Common Scold



The Common Scold is named after a cause of action that originated in Pilgrim days, when meddlesome, argumentative, opinionated women who displeased the Puritan elders were punished by a brisk dunk in the local pond. Believe it or not, the tort lasted until 1972, when State v. Palendrano, 120 N.J. Super. 336, 293 A.2d 747 (N.J.Super.L., Jul 13, 1972) pretty much put it to rest. But the thought of those feisty women, not afraid of a little cold water, has always cheered me up and inspired me. I first used the moniker as the name of my humor column at the University of San Francisco School of Law many moons ago, and revive it now for this blawg!

HAPPY NEW YEAR!

Hny Musings on the cusp: May the new year be full of contradictions and unexpected occasions. May the unpartnered find their loves; and the partnered find new reasons to cherish their mate.

May we experience both great pride and moments of sheer humility. May mother earth surprise us with her glory, but may we be protected from her dangers. (See right nav bar to donate to Tsunami charities).

May we find a book that embraces our spirit and changes our vision. May we take a risk we might not have taken in our youth.

May we see the ordinary with new eyes. May we listen better. Toast2_3

May we smile at the stars, bite into a ripe pear, sing to the crisp sky, be gentle on ourselves, and

........ may Joe and the boys get #27 :)

If you change the career of the protagonist to lawyer, in this classic haiku from Buson, I think you'll see a theme similar to one of your own:

Such a moon--
Even the thief
pauses to sing.

Well, maybe no career change is needed.
